So.. what if this instructor was not rated in category and class, nor 
current for passengers... in said airplane?

There is no written rule in the FAR's that demands someone with a CFI or 
CFII rating automatically become the PIC. Who is PIC and who is acting 
as PIC should be determined in advance of the flight by the involved 
parties.

I have recieved instrument instruction from someone before who elected 
not to log his instructional time as PIC in certain circumstances. It's 
safe to say he wasn't a timebuilding 20 year old aspiring airline pilot 
either... He was a retired aeronautical engineer, CFII and A&P/IA.
