REFLECTOR: Flight training

There you go again, Pat...putting safety ahead of FARs and the FAA regs,
or at least their interpretations of them.  Some of us will just never
learn!

On the serious side, a while back this issue was discussed in detail on
the RV website.  The consensus was there wasn't one with the legal
beagles coming down on the side of 'there's now way the FAA would buy
it' to others that cited the regulations and the pilot/builders leeway
in interpreting the regs, particularly as it relates to essential crew.
One thing is certain, two pilots, with good CRM, brings a far greater
level of safety to most all flight regimes compared to a solo pilot.
The small amount of additional weight is a miniscule cost to incur given
the improved safety.  

Perhaps someone can cite definitive case law (case law trumps written
law) on the matter that argues against it, otherwise, the decision may
ultimately rest on that "between two consenting adults thing...."

I got some seriously conflicting opinions on this one!
Someone at the factory said there's no-way, if the
sh#@ hits the fan, you're going to be able to justify
to the FAA that someone was a 'required crew
member.'On the other hand, my DAR told me that it's
completely up to me to decide if one was necessary for
any given flight. In the end, legal or not became
academic - I went up a couple times with my seasoned
test pilot before flying alone because I felt it was
the safest thing to do.
